STATUS OF R-ARCSS IMPLEMENTATION

 

 

OVERSIGHT OBSERVATION OF THE IGAD COMMUNIQUE

DATED 21ST AUGUST, 2019 ETHIOPIA

Abstract: This report intend to offer perspectives on the recent issued IGAD Communique dated 21st August 2019 on R-ARCSS implementation. The communique of IGAD is too ambition. IGAD communique decided to set up new deadline for the deliverance of the pre-transitional period pending tasks. While it is well known that if the top leadership of the parties to R-ARCSS have no interest for meeting the set deadline, they can do so as it was seen in the past several times. The desire for genuine implementation of the R-ARCSS is fully depends on the political will and commitment of the principals of the parties’ signatories to R-ARCSS    

SUGGESTIONS FOR EXECUTION OF THE IGAD COMMUNIQUES

  1. Commits to engage their respective Heads of State and Government to directly engage H.E. President Salva Kiir to disburse the balance of the pledged USD 100 million;

  2. The IGAD Council of Ministers should develop plan for tracking the pledged USD 100 Million

  1. Further recommends to the Heads of State and Government to hold an Ordinary Summit of IGAD in mid-September 2019 to deliberate on and decide, among others, the status of Dr. Riek Machar;

The mid-September Proposed Ordinary Summit of IGAD should be taken serious by the current leadership of IGAD. This summit is necessary for the fate of R-ARCSS and specifically parties compliance with 12th November 2019  

  1. Resolves that at least 50% of the 83,000 necessary unified forces should be cantoned and barracked, trained and deployed before the end of September 2019;

Serious commitment is required for accelerating cantoning and barracking of forces. Further, adequate and timely release of funds for security arrangement activities such as training and redeployment of the 41,000 necessary unified forces is urgently required

  1. Welcomes the adoption of the Terms of Reference of the DDR Commission by the Parties and stakeholders, and the subsequent nomination of candidates by all except the TGoNU and in this regard decides that the reconstitution of the DDR Commission should be completed by the end of August 2019;

  1. Urges the Parties to continue dialoguing and consulting on the issue of the number and boundaries of states with a view to find a common solution, and report on the same to the next IGAD Ordinary Summit in mid-September;

KEY CONSIDERATIONS

  1. Political Will and Commitment

The issue of the moving forward successfully is mostly determinate by the availability of funds but also one of the central aspect for accelerating genuine and timely implementation of R-ARCSS is the political will and commitment of the principals of the parties’ signatories to R-ARCSS. Political parties top leadership tactic of dragging feet on availing political will and commitment clearly shows that the principals have no good faith politics for embracing the political culture of working together for the benefit of the society besides their political difference. 

  1. Financing security arrangements as top priority

September 2019 deadline is seriously determinate by how much cash are availed for the implementation of the essential security arrangement steps. It is clearly that safety and protection of the political parties are determinate by their trust and confidence about the set up systems for ensuring their safety and protection although they do express opinion that their safety and protection is not a priority more than the safety and protection of civilians 

  1. IGAD Performance prior September 2019 Deadline

IGAD should take steps of getting involved in tracking the parties’ compliance with the September 2019 deadline. CEPO observed that IGAD Special Envoy to South Sudan is keen to ensure that the parties act urgently on implementing the pending tasks that are identified as pre-conditions for establishment of the Revitalized Transitional Government of National Unity on 12th November 2019. The weak and sometimes contradictory role played by some IGAD member states is weakening IGAD in holding the parties to the R-ARCSS to account. Consensus among the IGAD members’ states is essential. Lack of consensus among them has made them unable to deliver some of their promises such as calling for organization of regular face-to-face meeting of the top leadership of the parties to R-ARCSS. Without the conduct of the regular face-to-face meeting of the top leadership of the parties to R-ARCSS the chance of meeting the given deadlines by IGAD is very low      

KEY CHALLENGES ON THE ROAD TOWARD COMPLIANCE WITH SEPTEMBER 2019 DEADLINE  

  1. The parties are unproductive on their own to deliver the R-ARCSS required pre-transitional period tasks without regular IGAD pressure
  2. Some IGAD member states are not in their great interest to engage for genuine South Sudan peace process. They turn to contradict IGAD interest during building of consensus on IGAD leadership decision on South Sudan Peace Process
  3. IGAD’s unbroken alleged detention of Dr. Riek Machar verses the need for him to join H.E. the president and the other political parties’ leaders for genuine implementation of R-ARCSS is a dilemma that requires urgent resolution
  4. The parties’ level of feeling ready to work together for execution of R-ARCSS is very low and much of their interest for working together for success is determined by the solutions on the pending tasks of security arrangements and the resolution on number and boundaries of the states
  5. Inadequate and untimely release of funds including misappropriation of funds in the name of peace tasks implementation 

RECOMMENDATIONS

  1. Parties to R-ARCSS should get urgently to meet at capacity of principal as called by IGAD communique dated 3rd May 2019. Sudan and Uganda should take primary role in ensuring this face-to-face meeting of the top leadership of the parties take place before end of September deadline.
  2. H.E. the President of the Republic of South Sudan should ensure that funds allocation is made priority for the implementation of the security arrangements in transparent and accountable manner before the end of September deadline
  3. The principals of the parties’ signatories to R-ARCSS should take primary responsibility of making hard political decision on the pending tasks of the pre-transitional period with spirit of working together for compliance with 12th November 2019 where inclusive revitalized transitional government of national unity will be establish
  4. IGAD should organize the face-to-face meeting of the top leadership of the parties before the deadline of September 2019. If possible let it be in Juba with effective participation of Sudan leadership in offering assurance for safety and protection of other political parties’ leaders who felt not secure

CEPO’S ROLE

CEPO will be engage in lobby and advocacy activities with IGAD member states missions in Juba specifically on pursuing the IGAD member states to expedites the face-to-face meeting of the top leadership of the parties to R-ARCSS before the IGAD meeting on assessing the parties compliance with the Month of September 2019 deadline. Keeping the political momentum observe during the peace celebration day in Juba on 31st October 2018 was required from now till 12th November 2019. Based on this CEPO will be organizing in partnership with other government and civil society organization peace campaign called “10 DAYS FOR NATIONAL PEACE ACTIVISM”. The period of the campaign will from 12th September 2019 to 21st September 2019 across the country. Preparation are already for the campaign

CONCLUSION : The ultimate public interest for the parties signatories to R-ARCSS is compliance with 12th November 2019 where inclusive revitalized transitional government of national unity is establish without any excuse.
