STATUS OF R-ARCSS IMPLEMENTATION .

2ND MONTH OF THE SIX EXTENDED MONTHS FOR PRE-TRANSITIONAL PERIOD PRACTICAL OPTIONS AT HAND FOR COMPLIANCE WITH 12TH NOVEMBER 2019

Abstract: This report specifically is offering a new thinking within the spirit of advocacy and lobby for genuine and timely execution of the extended six months for pre-transitional period for implementation of the pending tasks as pre-conditions for the establishment of the Revitalized Transitional Government of National Unity on the 12th November 2019.

For compliance with 12th November 2019 to happen, change in political attitudes is essential and required among various actors around the R-ARCSS Implementation. It will be a grave mistake if primary actors never stop the culture of sticking on the political attitudes full of pre-conditions that never allow positive steps for making progress in R-ARCSS implementation.

At the moment any deficit in political trust and engagement is an act of pre-violence. Right now all thinking has to be geared towards practical options at hand for making compliance with 12th November 2019 realized without any failure          

  1. UPDATES ON THE STATUS OF R-ARCSS IMPLEMENTATION
    1. PROGRESS MADE
  1. Ceasefire is holding among the parties  signatories to R-ARCSS since September 2018
  2. National Pre-Transitional Committee Dissemination Unit officially developed joint R-ARCSS dissemination strategy in partnership with CEPO.
  3. National Pre-Transitional Committee Dissemination Unit trained Yei River State officials as disseminators of R-ARCSS in partnership with CEPO.
  4. Strategic Defense and Security Review Board completed focus groups discussions with refugees in Sudan, Ethiopia, Uganda and Kenya.
  5. Revitalized Joint Monitoring and Evaluation Commission engaged in several R-ARCSS dissemination activities among various stakeholders. 
  6. Ceasefire and Transitional Security Arrangements Monitoring and Verification Mechanism (CTSAMVM) confirmed improvement in access
  7. Ceasefire and Transitional Security Arrangements Monitoring and Verification Mechanism CTSAMVM verified 27 out of 35 cantonments of forces sites.
  8. 18th out of 20th  sites for training of unified national army and security institutions verified
  9. Security Arrangement Mechanisms conducted updates on security arrangements workshop on 16th July 2019
  10. Parties agreed on the size of the protection Unit of Very Important Person’s (VIP).  
  11. National Pre-Transitional Committee Reconciliation and Healing unit is organizing national approach to Reconciliation and Healing in partnership with CEPO.
  12. Strategic Defense and Security Review Board  is planning Internal Displaced Persons and faith based leaders focus group discussions on security reform assessment in partnership with CEPO
  13. Reasonable reduction in hostile propaganda and hate speech in social media is witnessed after the extension of the pre-transitional period to six months, but misinformation is getting active in social media about the R-ARCSS implementation.      
    1. PERSISTENT CHALLENGES
  1. Deficit in political commitment and will among the political leaders of the parties to R-ARCSS.
  2. Political elites from various parties to R-ARCSS inflexibility in prioritizing the R-ARCSS implementation.   
  3. Slow and ineffectiveness remittance of the funds for peace implementation by the government
  4. The culture of escaping primary responsibility for making peace happens by blaming the international community.
  5. The cantonment of the forces sites are facing logistical and finance constraints.
  6. Demilitarization of the civilians centers by all the forces not yet conducted effectively.
  7. Intergovernmental Authority on Development inconsistence in influencing the parties to R-ARCSS for timely deliverance of pending tasks that were pre-conditions for establishment of Revitalized Transitional Government of National Unity.
  8. Unclear direction on the fate of Regional Protection Forces (RPF).
    1. KEY CONCERNS
  1. Intergovernmental Authority on Development’s influence is weakening due to the situation of insecurity in Sudan and Ethiopia.
  2. Parties to R-ARCSS maintaining high level of political doubt for working together for the genuine and success implementation of R-ARCSS.
  3. Africa Union Ad hoc committee compose of Nigeria, South Africa, Rwanda, Chad and Algeria are not playing enough influential role
  4. Intergovernmental Authority on Development and African Union partnership is not strong enough as pressure coalition on the parties to R-ARCSS for the deliverance of R-ARCSS as per the citizen’s expectations.
  5. The dilemma around Regional Protection Forces (RPF) is contributing in generating the parties to R-ARCSS doubt on the regional and international community willingness for ensuring protection and safety of VIP members of the parties.   

 

  1. PRACTICAL OPTIONS AT HAND FOR GAINING COMPLIANCE FOR 12TH NOVEMBER 2019 
    1. THE GOVERNMENT AND NATIONAL PRE-TRANSITIONAL COMMITTEE (NPTC)
  1. The Government should move faster in allocating funds for executing the pending tasks of the pre-transitional period.  
  2. National Pre-Transitional Committee leadership should stand firm for ensuring that national funds are first prioritize for R-ARCSS implementation.
  3. National Pre-Transitional Committee leadership should embrace technical dialogue with the diplomatic community for setting of functional and realistic priorities for R-ARCSS Implementation.
  4. National Pre-Transitional Committee ensures that Joint Defense Board, Joint Military Ceasefire Commission and Joint Transitional Security Committee  to keep the public updated on security arrangement implementation in terms of progress made and challenges faced.
  5. National Pre-Transitional Committee should help in fostering the execution of the regular face to face meeting of the top leadership of the parties to R-ARCSS.
  6.  National Pre-Transitional Committee-Dissemination Unit should increase the utilization of the various media platforms for disseminating the R-ARCSS.
  7. National Pre-Transitional Committee-Healing and Reconciliation Unit should seek for partnership for executing their mandate.
    1. IN THE SECURITY ARRANGEMENTS ARENA 
  1. Urgent allocation of funds for security arrangements especially for Very Important Persons (VIP) protection unit establishment and training of necessary unified forces by July 2019.
  2. Urgent establishment of unified Defense and Security command at central level for directing unified defense and security decision on establishing unified defense and security forces. For instance extended the mandates of  Joint Defense Board  and Joint Transitional Security Committee to transitional period under single commend   
  3. Expedites the training of the necessary unified forces by September 2019 and deploy the trained unified forces by early October 2019
    1. IN THE GOVERNANCE ARENA
  1. Urgent enactment of the Revitalized Transitional Constitution of the Republic of South Sudan
  2. Urgent endorsement of the amendments of the five security laws  
  3. Resolving the issues of the number of the state disputes through top leaders of the parties meeting consensus. The option of subjecting land political administrative disputes as key element of constitutional making process should be consider    
  4. Starting responsibility sharing dialogue among the parties to R-ARCSS is essential.

 

 

 

  1. GUARANTORS  RENEWING THEIR PLEDGE AND COMMITMENT 
    1. INTERGOVERNMENTAL AUTHORITY ON DEVELOPMENT MEMBERS ETHIOPIA, UGANDA AND SUDAN PLUS KENYA.
  1. Ensure Intergovernmental Authority on Development resolutions are executed by the parties to R-ARCSS. Intergovernmental Authority on Development  resolutions such as facilitation of regular face to face meeting of the top leadership of the parties to R-ARCSS is urgently executed 
  2. Ethiopia Prime Minister and Uganda President should engage regular in pursuing the principals of the parties towards compliance with  12th November 2019 
  3. The recent Kenya’s President appointed Special Envoy to South Sudan DR. STEPHEN KALONZO MUSYOKA should conduct urgent situational appraisals for fostering the spirit of getting the top leadership of South Sudan parties for compliance with 12th November 2019
  4. Any current face to face meeting of the leadership of the parties should response to the inquiry ; what are the practical options for compliance with 12th November 2019
  5. Intergovernmental Authority on Development  Special Envoy to South Sudan should lobby for urgent triple team meeting compose of Intergovernmental Authority on Development, Africa Union and United Nations to meeting each party leadership on matters of compliance with 12th November 2019    
    1. AU C5 NAMELY RWANDA, NIGERIA, SOUTH AFRICA, CHAD AND ALGERIA
  1. The recent African Union  ad hoc committee (AU C5) communique on the situation of South Sudan is remarkable if the following proposed interventions are expedite before September 2019;
  1. AU C5 member states Ministers of Foreign Affairs conducting situation appraisals towards South Sudan Parties compliance with 12th November 2019
  2. AU C5 members states Presidents conducting situation appraisals towards South Sudan Parties Top leadership compliance with 12th November 2019
  1. The Government of Egypt at the capacity of Africa Union Chair at the current term of office should facilitate urgent regular face to face meeting of the top leadership of the parties to R-ARCSS in August, 2019. 
  1. WITNESSES AND FRIENDS OF SOUTH SUDAN
    1. TROIKA GROUP (USA, UK AND NORWAY) 
  1. Embrace technical dialogue with the National Pre-Transitional Committee (NPTC) and other R-ARCSS implementation mechanisms technical staff on setting realistic priorities for support and expediting the implementation of R-ARCSS
  2. The Troika should engage with the principals to the Peace agreement through diplomatic means to encourage them to ensure the realization of the 12th November 2019
  3. The Troika also need to engage with Intergovernmental Authority on Development  to encourage them to enhance efforts towards the realization on the peace process in South Sudan
  4. Stand firm for expediting the new UNMISS renewed mandate on supporting the R-ARCSS implementation process including UNMISS partnering with other stakeholders for implementing prevention of Sexual Gender Based Violence  and Conflict-Related Sexual Violence
  5. Offering support for R-ARCSS implementation through Intergovernmental Authority on Development  in same manner like supporting High-level Revitalization Forum
    1. INTERGOVERNMENTAL AUTHORITY ON DEVELOPMENT  PARTNERS FORUM
  1. Follow Japan Footsteps for supporting R-ARCSS implementation through Intergovernmental Authority on Development
  2. Take steps of supporting East African Community technical engagement on R-ARCSS implementation. East Africa Community should be encourage to deploy experts for aiding the peace implementation process

  

  1. CONCLUSION:

Without a change of political attitudes from negativity to positivity from all actors’ around implementation of R-ARCSS, compliance with 12th November 2019 will not happen as expected by all and this would undermine the hopes and progress so far made towards peace in the country. 

This is the most opportune time for actors to increase and enhance efforts, build trust, confidence and consolidate peace in South Sudan- failure of which is a threat to sliding the county back into violence. The issue of the Ebola preparedness should be taken serious by the parties in conflict and peace partners. Allowing health actors to have free access and mobility for fostering effective Ebola preparedness is paramount. We (CEPO) got encouraged with the on-going Ebola preparedness across the country.

Finally, the implementation of the peace process should apply an inclusive process that actively ensures participation of women, youth, victims of the war, civil society organizations, among others.
