OBSERVATION REPORT ON THE STATUS OF R-ARCSS IMPLEMENTATION .

OVERSIGHT OBSERVATION REPORT ON THE SOUTH SUDAN PARTIES’ PERFORMANCE WITH THE FIRST 50 DAYS OF THE EXTENDED 100 DAYS FOR THE PRE-TRANSITIONAL PERIOD

Abstract: This report presents summary of CEPO oversight observation findings on the performance of South Sudan parties to the Revitalized Agreement on the Resolution of Conflict in South Sudan within the first 50 days of the extended 100 days for the pre-transitional period. The overall findings demonstrated that no considerable progress was realized during the first 50 days apart from the intensified face-to-face meeting between President Salva Kiir and the SPLM-IO leader Dr. Riek Machar. The face-to-face meeting have registered some impressive progress if the meeting outcomes are genuinely implemented before the end of the last 100 days. Among the key outcomes are the speedy implementation of the security arrangements critical pending tasks within the month of January 2020; commitment for continuous deliberations on the resolution of the issue of number and boundaries of the states; agreed upon freedoms namely freedom of media, political freedom and freedom of movement. The parties are required to take serious primary responsibility to make meaningful compromises and concessions through political consensus for breaking through on deadlocks for meeting the deadline of 22th February 2020

1.     KEY FINDINGS

1.1.          POLITICAL CRITICAL PENDING TASKS OF PRE-TRANSITIONAL PERIOD

a)     The incorporation of the R-ARCSS into the Transitional Constitution 2011 still is unaccomplished

b)     The enactment of the amendments proposed on five security laws still are unaccomplished

c)      The deliberations on responsibility sharing among the parties at all levels of the government is in silence

d)     The issue of the number and boundaries of the states still is a serious deadlock

1.2.          SECURITY ARRANGEMENTS CRITICAL PENDING TASKS OF THE PRE-TRANSITIONAL PERIOD

a)     Cantoning and barracking of forces is in progress

b)     Registering and screening of forces is in progress

c)      Preparation for training of registered and screened forces as unified forces is in progress

 

2.     KEY CONCERNS

a)     Without resolving the issues of the number and boundaries of the states urgently through political consensus among the parties’ signatories to R-ARCSS, the public opinion around R-ARCSS is getting polarize so faster. This is a risk for the fate of the public trust and confidence on R-ARCSS

b)     Slow engagement on the critical pending tasks of security arrangements should be discourage by the principals of the parties to R-ARCSS

c)      Parliament silence on the enactment of the amendments proposed on the five security laws including incorporation of the R-ARCSS into the constitution is demotivating

d)     Increased on hate speech and hostile propaganda is observed recently associated with issue of the number and boundaries of the states

e)     Genuine implementation of the recent agreed upon freedoms namely Freedom of media, Political freedom and freedom of movement for civilians

f)       Expediting genuine Disarmament and Demobilization and Reintegration in line with the process of building unified forces

 

3.     RECOMMENDATIONS AND WAY FORWARD  

Within the next 40 days of the remaining 50 days of the extended 100 days for pre-transitional period the following actions should be delivered;

a)     The next face-to-face meeting of President Salva Kiir and SPLM-IO leader Dr. Riek Machar plus other principals of the other parties’ signatories to R-ARCSS should urgently reach conclusion on the issues of number and boundaries of the states through compromises, concession with full political consensus

b)     The South African Government Deputy President should seriously engage the principals of the parties to R-ARCSS on middle ground on the issue of the number and boundaries of the states

c)      There is need to speedy up the process for training and redeploying the unified forces

d)     The National Transitional Parliament should act on the enactment of the amendments on the five security laws including incorporation of R-ARCSS into the transitional constitution 2011

e)     There is a need for the government to adequately finance the dissemination of R-ARCSS to the public. If possible, there is a need to extend the mandate of NPTC Dissemination Unit, Healing and Reconciliation Unit and Humanitarian Unit till the full government institutions with the same mandate are established

f)       The political parties should start engaging in disseminating R-ARCSS across the country since political freedoms, freedom of media and freedom of movement are agreed upon by H.E. President and SPLM-IO leader in their meeting dated 17th December 2019 in Juba

g)     The principals of the parties to R-ARCSS should ensure that their enforced genuinely the agreed upon affirmative action of 35% for women during the formation of the Revitalized Transitional Government of National Unity

h)     Every South Sudanese should abstain from engaging on hate speech and hostile propaganda in means of the media outlets being it online and offline

i)       The South Sudan DDR Commission should develop public and soldiers sensitization strategy on the importance of responding positively to DDR processes    

j)       There is a need for the South Sudan DDR Commission to be adequately funded for handling DDR process genuinely and effectively in line with the process for building unified forces 

4.     THE ROLE OF CEPO: CEPO will be reaching out to South Sudan DDR commission for partnership over public and solider sensitization over the importance of responding positively to the DDR process. Our advocacy and lobby over some of the critical pending tasks of the pre-transitional period will continue with the parties to R-ARCSS and the relevant partners for the R-ARCSS implementation. CEPO will be fully engaged in tracking the implementation of the three agreed upon freedoms namely Freedom of Media, Political Freedom and Freedom of Movement for civilians      

CONCLUSION: The kick-off of the unified forces training is impressive and provide good beginning of the last 50 days. The fate of R-ARCSS will be determine by the success registered during the next 50 days of the extended 100 days for the pre-transitional period. The success of the 100 days will be much depending on financing the process for delivering the pending tasks of the pre-transitional period and resolution on the issues of number and boundaries of the states. Therefore accountable and transparent use of the funds allocated by H.E. President for the R-ARCSS implementation by National Pre-Transitional Committee is paramount. All parties to R-ARCSS should get engage in disseminating the R-ARCSS. CEPO is calling for IGAD to conduct the evaluation of the 50 days performance urgently in early January 2020 with the participation of all parties and stakeholders to R-ARCSS
